Is this film in the public domain?

The source material clearly is, and the copyright on the film itself says
1918... But it was released in 1938, which may give it copyright status as a
derivative work. Then again, all the actual footage besides the titles are
in public domain! So where does this film stand?

I doubt if anyone bothered to renew the 1938 copyright. Tom Dunahoo
of Thunderbird Films used to sell 16mm prints of FESTIVAL--if I recall
corraectly--and never got in trouble for it, although he got in a lot
of trouble for thinking the first season of STAR TREK was public domain
and sold super 8mm and 16mm prints of that.

You can always call up the Margaret Herrick Library in Beverly Hills
(310-247-3020) and ask the reference librarian to look it up in THE
FILM SUPERLIST. He'll tell you in thirty seconds whether the copyright
was renewed or not, and all it'll cost you is the phone call.

A possibility is that THE CHARLIE CHAPLIN FESTIVAL was never
copyrighted in the first place. I wonder if its sister film, THE
CHARLIE CHAPLIN CARNIVAL, ever got copyrighted.

Anyway, if there's no record of a renewed copyright, you're safe.

LOL.

Thanks. I was thinking about posting the whole thing online at
silent-movies.org as a streaming MP4 file, along with some other PD titles I
have before they go to dust on VHS.

And the Margaret Herrick Library's answer to my copyright question is...
They don't know,

"Charlie Chaplin Festival" isn't listed in THE FILM SUPERLIST. Now, what
does that mean? Could Chaplin have simply skipped the copyright process, as
these films were copyrighted at the time?

Good question.
There's a third one called CHARLIE CHAPLIN CAVALCADE too. The three films
cover all twelve Mutuals. Interesting that they appear to be organized in
the same way as the Shepard DVDs. I wonder if it is some sort of official
pattern tp them?

Excellent, I'll be posting it online then.

I urge any and all to visit this library,
which I believe is located on San Vicente
and Olympic. It is the Vahalla of
film aficionados and a template
for all film literature collections.

I wonder if the music scores on these might still be copyrighted?
Seems everytime someone releases the Chaplin Mutuals in the RKO/Van
Beuren versions these days, they always replace the soundtrack.

Hello, David,

Please consider also posting it to archive.org so it will be permanently
available to everyone in many different formats. :)
